The owner of the online store Herbazen.eu (hereinafter, the online store) is Herbazen OÜ, located at Malmi 6 / 1-3, Tallinn, EE10412.
Validity of the sales contract, goods, and price information
The terms of sale apply to the purchase of goods from the online store.
The prices of the products sold in the online store are indicated in euros. A fee for delivery of the goods is added to the price.
The fee for delivery of the goods depends on the location of the buyer and the method of delivery.
The delivery fee is displayed to the buyer when ordering. Information about the goods is provided in the online store, directly next to the goods.
Placing an order
To order, you must add the products you desire to the shopping cart. To place the order, fill in the required data fields and select the appropriate delivery method. Then, the amount of your fee is displayed on the screen, which can be paid via the Estonian bank link or another payment solution. To confirm the order, 100% of the order amount (including the transport price) has to be paid by the customer.
The agreement enters into force upon the receipt of the amount due by the online store’s current account.
If the ordered goods cannot be delivered due to the goods running out or any other reason, the buyer will be notified as soon as possible and the money paid (incl. delivery costs) will be refunded immediately, but no later than 14 days after sending the notice.
Shipping costs are paid by the buyer. The corresponding price information is displayed next to the shipping method.
Shipments within Estonia generally reach the destination specified by the buyer within 3-7 working days of the sales contract entering into effect. The order is fulfilled within a maximum of 48 hours after payment, after which the goods are sent to the addressee via the service provider chosen by the customer. Shipments within Estonia usually arrive the next day after posting the parcel.
Delivery outside Estonia occurs within 30 calendar days. In exceptional cases, we have the right to deliver the goods within up to 45 calendar days.
Methods of order delivery
Omniva Post24 service - Parcel machines are located in the most visited places of 31 settlements all over Estonia. This ensures that parcel machines can be used around the clock. The cost of the service is 2.95€.
Smart POST service - With SmartPOST indoor parcel machines, there is no need to worry about cold, heat, or moisture damaging your shipment. Parcel machines are located all over Estonia, and more locations are constantly added. The cost of the service is 2.99€.
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days from the receipt of the ordered goods and to return the goods in unused form, without damaging the packaging. The consumer must return the goods to the seller no later than within 14 days of submitting the withdrawal application.
The right of withdrawal does not apply if the buyer is a legal person.
In order to exercise the 14-day right of return, the ordered goods may not be used in any way other than what is necessary to verify the nature, characteristics, and functioning of the goods in the manner permitted for testing the goods in a physical store.
If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics, and functioning of the goods or if there are signs of use or wear, the online store has the right to reduce the refundable fee according to the decrease in the value of the goods.
In order to return the goods, a withdrawal application must be submitted. This form can be found here: withdrawal application. Once completed, it can be sent to the e-mail address email@example.com no later than within 14 days of receipt of the goods.
The costs of returning the goods shall be paid by the buyer, unless the reason for the return is due to the item not corresponding to what was ordered (e.g., a wrong or defective item).
The buyer must return the goods within 14 days of submitting the application or provide proof that he has handed over the goods to the carrier within the aforementioned period.
Upon receival of the returned goods, the online store shall immediately, but not later than 14 days after receipt of the withdrawal application, return to the buyer all fees received from the buyer on the basis of the contract.
The online store may refuse to give refunds until the item that is the subject of the contract has been returned or until the buyer has provided proof that he has returned the item, whichever is earlier.
If the buyer has explicitly chosen a delivery method different from the cheapest usual delivery method offered by the online store, the online store does not have to reimburse the consumer for a cost that exceeds the cost related to the usual delivery method.
The online store has the right to withdraw from the sale transaction and demand the goods back from the buyer if the price of the goods in the online store is marked significantly below the market price due to a mistake.
Right to lodge a claim
The online store is liable for any non-compliance or defect of the goods sold to the buyer which already existed at the time of delivery and which becomes apparent within two years of the delivery of the goods to the buyer. During the first six months after the delivery of the product to the buyer, it is presumed that the defect already existed at the time of delivery. It is the responsibility of the online store to rebut the respective presumption.

The online store is not responsible for defects that occur after the delivery of the goods to the buyer.
If the goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods.
If the goods cannot be repaired or replaced, the online store will return to the buyer all fees associated with the sales contract.
The online store shall respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.
Direct marketing and processing of personal data
The online store uses the personal data entered by the buyer (incl. name, telephone number, address, e-mail address, and bank details) only to process the order and send the goods to the buyer. The online store transmits personal data to transport companies in order to deliver the goods.
The online store will send the newsletters and offers to the buyer's e-mail address only if the buyer has consented by entering their e-mail address on the website to receive direct e-mail notifications.
The buyer can cancel the offers and newsletters sent to the e-mail at any time by notifying us by e-mail or by following the instructions in the e-mails containing the offers.

If the buyer and the online store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The terms of the procedure can be found and the application submitted here. The Consumer Disputes Committee is able to resolve disputes arising from the contract concluded between the buyer and the online store. The review of the buyer's complaint in the commission is free of charge.
The buyer can turn to the European Union Consumer Dispute Resolution Platform.
Processing of personal data
Herbazen OÜ guarantees the confidentiality of the personal data of the online store’s users and does not sell/transmit/mediate the personal and contact data of the users to third parties, except in case of special agreements (upon publication of possible campaigns or the announcement of winners).
Herbazen OÜ is the chief processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.
Modification of the terms of sale
Herbazen OÜ has the right to change the terms of sale at any time. The current version is always available on our website.
